The Administrative Simplification provisions of HIPAA requires the Secretary of HHS to adopt standards to ensure that covered entities maintain reasonable and appropriate administrative, physical, and technical safeguards for the security of certain individually identifiable health information.11 The statute requires that the standards do the following:
Ensure the integrity and confidentiality of the information.
Protect against any reasonably anticipated threats or hazards to the security or integrity of the information and unauthorized uses or disclosures of the information.
Ensure compliance with the Administrative Simplification provisions of HIPAA by the officers and employees of covered entities.12
HHS developed a proposed rule that included standards for protecting the confidentiality, integrity, and availability of ePHI and released it for public comment on August 12, 1998.13 The Department received approximately 2,350 public comments. The final regulation, Standards for Privacy of Individually Identifiable Health Information (commonly known as the Security Rule), was published February 20, 2003.14 At this time, the Security Rule only applied directly to covered entities, requiring that they implement a series of administrative, physical, and technical safeguards to ensure the confidentiality, integrity, and availability of ePHI.
